New Jersey Driving While Intoxicated Law
New Jersey has a different system from many of the other States, in that being arrested for DWI will not lead automatically, thus your license will not be suspended by the State's administrative bodies but rather only in court.
Charges for DUI in New Jersey can be prosecuted either on the basis of Blood Alcohol Concentration, which is currently set at a maximum of 0.08% or through proving impairment through “field sobriety tests”, driving patterns or through the testing of breath, blood or urine. Under 21's have a reduced BAC limit of 0.01%, and being convicted of DWI will lead to the suspension of drivers' license for between 30 and 90 days as well as community service for 15 to 30 days.

| Second | Minimum jail sentence of 48 hours up to 90 days, fines totaling around $6000, possible ignition interlock device fitted to your car. If offense occurs in a school zone, fine of between $1000 and $2000, 60 day community service, jail sentence of between 96 hours up to 180 days. |
| Third | Fines totaling around $6000, 180 days incarceration, ignition interlock device fitted to your car for 3 years. If the offense occurs in a school zone, a $2000 fine is imposed on top of these punishments. |
