Minnesota Driving Under the Influence Law

In common with many other States, a DUI arrest in Minnesota will lead to two cases being brought against the defendant, a criminal case and an Office Department of Public Safety case. If you have been arrested for DUI in Minnesota, you have only 14 days in order to apply for a hearing at the Department of Public Safety in order to retain your driver's license. It is therefore essential that you contact a Minnesota DUI lawyer as soon as possible. Indeed Minnesota allows you to contact a lawyer in advance of performing a sample test. If you don't have a lawyer the police are responsible for giving you a copy of the phone book in which to find one. However, should you refuse to take a test your license will be revoked for up to a year.

Conviction Punishment
First License revoked for 90 days, if BAC is twice the legal limit then license revoked for 180 days. A fine of up to $3000, and up to 1 year in jail.
Second Regarded as a gross misdemeanor if conviction is within ten years of first offense. Punishable with a fine of up to $3000, a maximum of a year in jail, alcohol education course, possible impounding or license plates and forfeiture of the vehicle being driven. License revoked for 180 days, if BAC is twice the legal limit then license revoked for 360 days. Community service is also required in some cases.
Third Minimum of 90 days in jail, 30 of which to be served consequentially, up to $3000 fine, possible impounding of license plates and forfeiture of vehicle being driven, license revocation for 180 days, if BAC is twice the legal limit then license revoked for 360 days.
Fourth Minimum of 180 days in prison, up to 3 years, minimum fine of $14,000
