Florida Driving Under the Influence Law

In common with many other States, a DUI arrest in Florida will lead to two cases being brought against the defendant, a criminal case and a Florida Department of Highway Safety and Motor Vehicles case. If you have been arrested for DUI in Florida, you have only 10 days in order to apply for a hearing at the Florida Department of Highway Safety and Motor Vehicles in order to retain your driver's license. It is therefore essential that you contact a Florida DUI lawyer as soon as possible.

Charges for DUI in Florida can be brought under either, or both, the doctrine of being under the influence of alcohol or drugs whereby the defendant's mental or physical capabilities are impaired, in the opinion of the arresting officer, affecting the defendant's ability to drive. The second recourse of action is to Blood Alcohol Concentration, currently set at 0.08%, under which the defendant can be charged regardless of whether or not the person is impaired. This method is based on body chemistry rather than how the vehicle in question was actually being driven.

Conviction Punishment
First Up to 6 months in jail unless BAC exceeds 0.2%, when it is 9 months, fine of between $250 and $500; if more than 0.2% BAC between $500 and $1000. License revoked for 180 days and attendance of “DUI School”.
Second Up to 9 months in prison, unless BAC exceeds 0.2% then up 12 months. Fine of between $500 and $1000, if BAC exceeds 0.2% between $1000 and $2000. License revoked for 5 years if second conviction falls within 5 year period. Compulsory attendance of “DUI School”
Third Up to 12 months in prison, fine of between $1000 and $2500 if third conviction in more then 10 years, within 10 years between $2000 and $5000. Minimum 10 year revocation of license.
Fourth Up to 5 years in jail, minimum fine of $1000, unless BAC exceeds $2000, no upper limit. Permanent revocation of license.
